ISO CERTIFICATION: INTERNATIONAL STANDARD ORGANISATION

CRITERIA FOR GRANTING CERTIFICATION

  5. The client shall keep a record of all complaints and actions taken
  6. The client has undergone the stage-1 and stage-2 audits satisfactory and the recommendation of the audit team is favorable
 
CERTIFICATION PROCESS

Certification Agreement
On acceptance of the Quotation, this certification agreement is signed between granter and the client for providing certification of the client’s management system by the Organisation to the applicable international standard.

MAINTAINING CERTIFICATIONS

The Certification is maintained for a period of 3 years under the following conditions.

  • The Surveillance Audits are conducted as planned and the client has demonstrated that it continues to satisfy the requirements of the management system standard as confirmed by the Organisation.
  • All the non-conformance raised during previous surveillance are closed within the time frame agreed and correction and corrective actions for the non conformities raised during the current audit are identified and accepted by the Organisation as per conditions specified in section 2.5 of this agreement.   .
  • The Internal Audit and the management reviews are conducted as scheduled and there are no issues pending.
    The client shall maintain suitable records of customer complaints and keep the records of investigation and remedial actions taken with respect to such complaints for verification by the Organisation auditors.
  • All outstanding dues to the Organisation are paid.

REGISTRATION AND INCORPORATION OF A COMPANY

In India, incorporation of a company is governed by the Companies Act 1956. It is the most important piece of legislation that empowers the Central Government to regulate the formation, financing, functioning and winding up of companies. It applies to whole of India and to all types of companies, whether registered under this Act or an earlier Act. But it does not apply to universities, co-operative societies, unincorporated trading, scientific and other societies.

The Act is administered by the Central Government through the Ministry of Corporate Affairs and the Offices of Registrar of Companies, Official Liquidators, Public Trustee, Company Law Board, Director of Inspection, etc. The Registrar of Companies (ROC) controls the task of incorporation of new companies and the administration of running companies.

The Official Liquidators who are attached to the various High Courts functioning in the country are also under the overall administrative control of the Ministry. The set-up at the Headquarters includes the Company Law Board, a quasi-judicial body, having the principal Bench at New Delhi, an additional principal bench for Southern Region at Chennai and four Regional Benches located at New Delhi, Mumbai, Kolkata and Chennai. The organisation at the Headquarters also includes two Directors of Inspection and Investigation with a complement of staff, an Economic Adviser for Research and Statistics and other Officials providing expertise on legal, accounting, economic and statistical matters.
 
HOW TO REGISTER

For registration and incorporation of a company, an application has to be filed with Registrar of companies. Application for registration of a company accompanied by the selected names, Memorandum of Association and Articles of Association and other necessary documents is to be filed with the Registrar of companies of the State in which the company is proposed to be incorporated

 
TYPES OF COMPANIES

Under the Companies Act, an entrepreneur can form two types of companies, namely a private company or a public company.

A Private Company is one, the articles whereof contains the following restrictions:-

  • restricts the minimum paid up share capital to such an amount as may be prescribed but which shall not be less than rupees one lakh;
  • restricts the rights of members to transfer its shares, if any;
  • limits the number of its members to fifty excluding the past or present employees of the company who are members of the company;
  • prohibits any invitation to the public to subscribe for any shares or debentures of the company;
  • does not invite or accept any deposits from persons other than its members, directors or their relatives.

Also, the minimum number of members in a private company is two and such a company must have the words \'Pvt Ltd\' as the last part of its name.

A Public Company, as defined in the Companies Act, has the following features:-

  • its shares are freely transferable;
  • there is no ceiling on its membership;
  • it can invite general public to subscribe to its shares;
  • it has a minimum paid up capital of Rs.5 lakhs or such higher paid up capital as may be prescribed;
  • it is a private company which is a subsidiary of a public company.

Also, the minimum number of members in a public company is seven and such a company must have the word \'Ltd\' as last part of its name.

 
ISSUE OF CERTIFICATE OF INCORPORATION

The following certificate will be issued when all documents for registration are in order:

Form 8 - Certificate of Incorporation for a public company.

Form 9 - Certificate of Incorporation for a private company

  • File a declaration in Form-20 duly signed by one of the Directors.
  • Obtain the Certificate of Commencement of Business.
WHAT IS CE MARKING

The CE Mark is a conformity marking consisting of the letters CE. The CE Marking applies to products regulated by certain European health, safety and environmental protection legislation. The CE Marking is obligatory for products it applies to: the manufacturer affixes the marking in order to be allowed to sell his product in the European market.
CE is an abbreviation for Conformité Européenne, French for European Conformity. The CE Mark indicates that the product it is affixed to conforms to all relevant essential requirements and other applicable provisions that have been imposed upon it by means of European directives, and that the product has been subject to the appropriate conformity assessment procedure(s). The essential requirements refer, among other things, to safety, public health and consumer protection.

Please note that:

1. The CE Marking is not a quality-mark.
First, it refers to safety rather than to the quality of a product. Second, CE Marking is mandatory for the product it applies to, whereas most quality markings are voluntary.
2. Many people use the term CE Mark. Initially, this was the phrase used to indicate this conformity marking. However, CE Mark was officially replaced by the term CE Marking in 1993. Thus, it is better to speak of CE Marking.

It is also the passport for products/ equipments within and into the EU member countries.

WHAT IS THE CCC CERTIFICATE OR CCC MARK

CCC means "China Compulsory Certificate", or is abbreviated as "3C".

On Dec. 2001, the General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China, abbreviated as AQSIQ, and the Certification Accreditation Administration of the People's Republic of China announced the compulsory product certification system, named as "China Compulsory Certification", abbreviated as "CCC", to replace the Compulsory Supervision System for Product Safety Certification and the Safety License System for Import Commodities. For the products required compulsory certifications by the People's Republic of China, a catalogue, named as "First Catalogue of Products Subject to China Compulsory Certification" was announced. All those products in this catalogue must pass the certifications through the certification organizations designated by the People's Republic of China, and must not be sold, imported and used in sales activities until achieve related certificates with certificate marks. The CCC was effective from May 1, 2003.

PROCEDURES TO OBTAIN CCC

1. Initial Consultation
At first, if you are interested for CCC application, explain what kind of product you have, what’s your product model and specifications, product sample and description. If you can provide us some pictures of the product, it would be very helpful for us. After we receive the information about your product, we will provide you the best certification plan, the requirements for the application documents and blueprints, and the estimated initial related expense. We will send you some documents like Application Form, Agency Authorization Notification to fill in.
2. Application
When we receive the Application Form and the Agency Authorization Notification signed and returned by you, our associate will create a case number and begin to process your application. We will also work out the Certification Agency Agreement to clarify the certification business terms and conditions and the responsibilities of each other. Meanwhile, you may prepare other materials and documents as required.
3. Agreement Signing
When you sign and return the Certification Agency Agreement to us, you may need to pay the cost indicated in the terms of the agreement as well. After we receive the signed agreement and the payment from you, our associate will assign a specialist to take care your case and contact with appropriate lab and engineers.
4. Technical Support (Optional)
According to your request, our specialist will explain the standards and safety requirement related to your product, arrange test of real situation and structure pretest, translate the Chinese documents into English, and so on. The cost of technical supports may vary on the real situations.
5. Preparation for Test Submission
Our specialist will send you the feedback from the certification organization in time, and notify you any product sample requirement and cost required by test or retest, and all documents from the certification organization required to be signed by you, like application form of certification organization, structural parameters list, tracing service agreement, etc. You should prepare well the product sample and the document materials, and send to us.
6. Test submission
Our specialist will turn in your product sample, document materials and payment to the corresponding certification organization or lab, and keep tracing the procedures of the case, send the feedback about test information to you until the case is closed.
7. Retest
If test comes out some rejection, you may need to rectify and improve the product sample and resend the sample to do the retest. Or, you can cancel this case, and reapply when it's mature enough. We can provide opinions to help you for rectification and improvement.
8. Initial Factory Examination or Inspection before certificate issuance
After your case begun, the certification organization or designated inspection organization will come to your factory to do the initial factory examination or inspection before certificate issuance, to investigate the factory test and manufacturing procedures qualifying the requirements or not. To pass this examination or inspection is the prerequisite for you to achieve the certificate.
9. Follow-up services (Optional)
After the certification case is close, we can provide a series of annual services based on your requirement, like certificate mark purchase, translation of incoming, outgoing mails and documents, payment service, revised pages replacement, application change, etc.
